Turning Old Mine Sites into Cleaner Waterways: A New Path for Abandoned Mine Cleanup

For decades, thousands of abandoned mines across the United States have remained a difficult environmental problem. Long after mining operations ceased, waste rock and mine tailings can continue to affect streams, soil, wildlife habitat, and surrounding communities.

A recent project in Washington State may signal a new way forward.


In September 2026, the U.S. Environmental Protection Agency approved the first permit issued under the Good Samaritan Remediation of Abandoned Hardrock Mines Act of 2024. The permit allows Trout Unlimited to undertake cleanup work at the historic Bodie Mine in Okanogan County, Washington.


Removing a Longstanding Barrier to Cleanup

One of the challenges associated with abandoned mine sites has been determining who can safely take responsibility for cleanup.

At many historic sites, the original owners or operators are long gone. Organizations interested in voluntarily improving these properties could previously face significant concerns about assuming liability for contamination they did not create.


The Good Samaritan Remediation of Abandoned Hardrock Mines Act, signed into law in December 2024, created a pilot program designed to address that problem. Qualified organizations can obtain permits allowing them to perform certain investigation and remediation work while receiving protection from specific liability risks, provided they comply with the terms of the permit.


The program currently allows EPA to issue up to 15 remediation permits for low-risk abandoned hardrock mine projects during the pilot program.


What Will Happen at the Bodie Mine?

The Bodie Mine project focuses on Toroda Creek, where historic mine waste has contributed to contamination and erosion.


Under the approved plan, crews are expected to excavate and remove as much as 790 tons of contaminated mine tailings and sediment along approximately 400 linear feet of Toroda Creek. After the contaminated material is removed, the streambank will be reconstructed and stabilized, and native vegetation will be installed to help restore the surrounding habitat.

The work is intended to reduce the movement of mine-related contaminants into the creek while also improving streambank stability, soil and sediment conditions, and habitat for fish and wildlife.

That makes this project significant for more than one abandoned mine in Washington. It is the first real-world test of a federal program intended to make voluntary remediation easier at sites where contamination might otherwise remain untouched.


Where Surveying and Engineering Fit In

Environmental cleanup projects may begin with a regulatory or conservation goal, but successful implementation depends heavily on understanding the physical site.


Before earth can be moved or waterways restored, project teams need reliable information about existing conditions. Depending on the project, that may include:

  • Topographic and existing-condition surveys

  • Property and boundary information

  • Stream and drainage features

  • Existing structures and site improvements

  • Horizontal and vertical control

  • Earthwork and grading information

  • Construction layout and documentation

  • Post-construction or as-built surveying


Civil engineering can also play an important role where cleanup requires grading, drainage improvements, erosion control, stabilization, access improvements, or restoration of disturbed areas.


Good environmental decisions depend on good information—and accurate surveying provides the foundation for that information.


A Broader Lesson for Infrastructure and Redevelopment

The Bodie Mine project also illustrates a larger point about aging infrastructure and historically impacted properties: past land use can affect development decisions generations later.

Whether a site contains abandoned mine waste, obsolete infrastructure, drainage problems, or other remnants of previous development, understanding what exists today is often the first step toward deciding what comes next.
